LIMITATION OF LIABILITY STATEMENT

VanEvans Tours, LLC,  its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns does not own or operate any entity which provides, or is to provide, goods or services for your trip, including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, personal services arranged by you, etc. VanEvans Tours LLC acts only as an agent for the various independent suppliers that provide hotel accommodations, transportation, sightseeing, activities, or other services connected with this tour.  Such services are subject to the terms and conditions of those suppliers.  All services and accommodations are subject to the laws and regulations of the country in which they are provided.

VanEvans Tours, LLC’s, responsibility is strictly limited. VanEvans Tours, LLC,  is not responsible for the acts or failures to act, willfully or otherwise, of its suppliers, or of any other third party over whomVanEvans Tours, LLC, has no control. As a tour operator, VanEvans Tours, LLC, promotes, organizes and sells tours, which consist of surface transportation, excursions and accommodations that VanEvans Tours, LLC,  purchases or obtains from suppliers, who are themselves independent contractors separate fromVanEvans Tours, LLC.  Such services are subject to the terms and conditions of those suppliers.  VanEvans Tour, LLCshall not be responsible for breach of contract or any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay or injury to you or your travel companions or group members. Unless the term “guaranteed” is specifically stated in writing on your tickets, invoice or reservation itinerary, we do not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling or handling of personal effects.

VanEvans  Tours, LLC,  is not liable for any bodily injury or harm, accidents, property damage or personal loss as a result of, but not limited to: physical exertion for which the participant was not prepared; travel by plane, train, car, bus, boat or other mode of transportation (such as bicycle, horse, foot, kayak, etc.); consumption of alcoholic beverages; high altitude; forces of nature, such as high winds, hurricanes, flooding, etc.; heat exhaustion, equipment failure; civil unrest or terrorism; the availability (or lack) of medical services in remote areas and the quality thereof; abnormal conditions or developments; or any other actions, omissions, or conditions outside the travel agent’s control. VanEvans Tours, LLC,is also not liable for: expenses (e.g. meals, transportation, hotel costs) that are not specified as included in the price of the trip, but may be required to get to/from a starting or ending point. VanEvans Tours, LLC,reserves the right to make hotel and/or route alterations in order to improve the quality of a trip or better accommodate its guests.

VanEvans Tours, LLCreserves the right to accept and/or cancel reservations at our discretion.  Every attempt will be made to meet each client’s expectations and support the best interests of all travelers in the group. If during the reservations process, our team anticipates a tour may be disrupted by a traveler or that the behavior of a traveler may result in a negative outcome for other travelers, the traveler’s reservation will be cancelled and any penalties incurred will be the responsibility of that traveler.

VanEvans Tours, LLC, is in no way ever responsible for damage to personal electronics incurred on your vacation. This includes but is not limited to water damage, accidents, loss, and theft.

VanEvans Tours, LLCis not responsible for expenses incurred by guests in preparing for the tour (e.g. non-refundable advance purchase of air tickets, equipment, travel insurance, etc.) or for any additional travel arrangements made on your own.

VanEvans Tours, LLCis not responsible for checking and verifying passport, visa, vaccination, or other entry requirements of each destination, nor safety or security conditions at such destinations, during the length of the proposed travel.

VanEvans Tours, LLC uses many photos on its website (vanevanstours.com) that fall under the creative commons license. We try to credit the authors as best we can, but there are a lot of photos and mistakes happen. To that extent, if you see a photo we don’t have rights to or are using incorrectly, please alert us immediately so we can remove it or otherwise address the situation.

ASSUMPTION OF ALL RISKS AND RELEASE OF LIABILITY AGREEMENT

I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip to which I may subsequently transfer). I am voluntarily participating in this trip with the knowledge of the numerous risks and dangers involved including but not limited to: Physical exertion for which I am not prepared; forces of nature including climatic conditions; transportation failures whether by plane, train, auto, boat, canoe, kayak, bicycle, skis, horseback or other animal, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; civil unrest; terrorism; criminal activity; local laws; dangers associated with wild or other animals; breakdown or failure of equipment; construction failures or difficulties; high altitude; accident or illness or disease without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; and stolen, lost or misplaced luggage or property; abnormal conditions or developments; or any other actions, omissions, or conditions outside the control of VanEvans Tours, LLC. 

I acknowledge that the enjoyment and excitement of travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, and are a reason for my participation. I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND ACCEPT THE RISKS ASSOCIATED WITH THE TRIP.

I understand that all services and accommodations are subject to the laws and regulations of the country in which they are provided.

I acknowledge that the cost of all VanEvans Tours, LLCtrips is based upon trip participants executing this Assumption of Risk and Release of Liability Agreement. Therefore, as lawful consideration for being permitted to participate in such trip(s), I hereby release and discharge forever VanEvans Tours, LLC, their respective employees, agents, representatives, and assigns from and against any and all liability for any injury, damage, loss, accident, delay, or any other incident which may be caused by the negligence, defect, default of any company or person in performing these services.

I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release VanEvans Tours, LLC, from any and all liabilities to the maximum extent permitted by law.

I understand thatVanEvans Tours LLC, reserves the right to increase the tour price in the event of cost increases due to changes in hotel rates, currency fluctuations, etc. VanEvans Tours, LLC reserves the right to decline to accept or retain any person as a member of any tour or to cancel or alter the tour without notice. Accommodations are subject to change.

I acknowledge that medical services or facilities may not be readily available or accessible during all or part of the trip. Travel insurance, cancellation insurance and medical insurance for abroad are the sole responsibility of the traveler. The traveler is responsible for selecting a trip appropriate to his/her abilities and interest. The traveler is responsible for being in sufficiently good health to undertake the trip, to prepare for the trip by studying the itinerary and pre-departure materials sent by VanEvans Tours, LLC, and for bringing the appropriate clothing and equipment as advised therein. I understand that VanEvans Tours, LLCreserves the right to take photographic or film records of any of its trips and to use any such photographic or film records for promotional and/or commercial purposes, including use by third parties with whom VanEvans Tours, LLCmay engage in joint marketing, without any remuneration to me. I hereby assign to VanEvans Tours, LLCall right, title and interest I may have in or to any and all media in which my name or likeness might be used by VanEvans Tours, LLC.

I understand that VanEvans Tours, LLCreserves the right to refuse as a trip participant, or remove from a trip, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who it determines to detract from the enjoyment of the trip by others. I agree to follow all written and verbal rules of safety presented to me by VanEvans Tours, LLC.  Van Evans Tours, LLC,reserves the right to make route, hotel and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of guests.

I understand that I assume complete and full responsibility for, and hereby release the VanEvans Tours, LLCfrom any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety or security conditions at such destinations, during the length of the proposed travel.

Payment, Cancellation and Refund Policy

KNOWING AND VOLUNTARY EXECUTION:I have carefully read and fully understand the contents and legal ramifications of this Limitation of Liability Statement and Assumption of All Risks and Release of Liability Agreement, and the brochures and all other materials provided to me concerning my trip, including, but not limited to, those regarding cancellation and refund policies. I understand that if I must cancel the reservation, the cancellation fee will be determined according to the following formula:

Payment schedule for VanEvans group tours:

  • 20% of the total tour price is due on reservation to hold your spot on the tour and lock in the price.  This non-refundable.
  • Optional tour add-ons must be paid-in-full with the deposit
  • 50% of the total tour price is due 120 days before the tour start date
  • 100% (the balance) of the total tour price is due 60 days before the tour start date

Cancellation fees are per person as follows:

  • Trip deposit is non-refundable.
  • 61-119 Days before tour date: 50% of the tour price
  • 45-60 days before tour date: 75% of total price
  • 0 – 45 days before tour date: 100% of total price

 

Payment Schedule for Customized Tours/Itineraries

 VanEvans Tours, LLC requires an upfront trip commitment fee of $500 per traveler for all customized tours/itineraries, that is non-refundable but applicable to your final invoice.  This fee confirms our commitment to the traveler to work within requested guidelines and budgets as agreed before the planning of a trip starts. This assures us that you are committed to a collaborative process throughout the property selection and itinerary design stages of building your experience.  A collaborative process with us will result in an itinerary that does meet your needs, interest, requests and requirements. Total trip fee is due 180 days before the beginning of the trip.

Cancellation fees for a customized tours/itineraries are as follows:

  • The upfront trip commitment fee is non-refundable.
  • 151 – 179 days before tour date: 50% of total price
  • 121 – 150 days before tour date: 65% of total price
  • 91 – 120 days before tour date: 80% of total price
  • 61 – 90 days before tour date: 85% of total price
  • 31 – 60 days before tour date: 90% of total price
  • 0 – 30 days before tour date: 100% of total price

Exceptions to this policy cannot be made for any reason, including weather, terrorism, civil unrest, and personal or medical emergencies. I understand this is a legally binding and enforceable legal document and sign it of my own free will. I agree that if any portion of this Limitation of Liability and Assumption of All Risks and Release of Liability Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

Registration to Use the Website

In order to use this website, a user must first complete the registration form.  during registration a user is required to give certain information (such as name, address, phone number,  and email address).  This information is used to contact you about the products/services on our site in which you have expressed interest.  You may also be asked to submit demographic information such as gender and age) about yourself, but is not required for registration to use the site.

Registration for Our Tours

We request information from you on our order form.  To reserve a tour with us, you must provide contact information like name, address and email address, financial information (like credit card number and expiration date or checking account information).  We also request demographic information such as date of birth, passport number, flight information and information about your travel partners.  This information is used as necessary for purposes of reserving your accommodations, transportation, and activities during your tour and for billing purposes.  If we have trouble processing an order, we’ll use this information to contact you.

Sharing

We may share aggregate demographic information with our partners and advertisers.  This is not linked to any personal information that can identify any individual person.

And/or

We partner with other parties to provide specific services such as accommodations, transportation and itinerary activities.  When you sign up for these services, we will share names and other information such as passport numbers and travel partner information that is necessary for these parties to provide those services.  These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

Security

We take precautions to protect your information.  The you submit sensitive information with the website, your information is protected both online and offline.

Whenever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way.  You can verify this by lookin for a closed lock icon at the bottom of your web browser, or looking for “https” a the beginning of the address of the web page.

We also protect your information offline.  Only employees who need the information to perform a specific job (booking your tour, billing, customer service, managing tours) are granted access to personally identifiable information.  The computers/servers on which we store personally identifiable information are kept in a secure environment.
